1. About these terms
These terms govern your use of the mobile application Hush ("the App"), provided by Ask White ("we", "us"). By installing or using the App you agree to them. If you do not agree, please do not use the App.
2. What the App does
The App estimates the sound level around your device using the device's microphone and shows the result in decibels, together with statistics, a chart and an optional saved history.
3. The readings are an approximation
The App is not a measuring instrument and is not a certified or calibrated sound level meter. The values it shows are an approximation produced by a consumer smartphone microphone, and they vary with the device model, its case, its position and the surrounding conditions.
You must not rely on the App where a certified instrument is required — including, without limitation, occupational safety assessments, regulatory noise compliance, legal proceedings, insurance claims, or any decision about hearing health. For those purposes, use properly calibrated equipment or consult a qualified professional.
4. Microphone access
The App needs access to the microphone in order to work. It analyses the incoming audio in real time to compute a level. It does not record, store or transmit audio. See the Privacy Policy for details.
5. Free use and Premium subscription
The App can be used free of charge with advertising. An optional subscription, Hush Premium, removes advertising and unlocks unlimited history, detailed charts, data export, long and background measuring, fine calibration and widgets.
- Subscriptions are offered on a monthly or yearly basis and are billed through your Apple Account.
- A subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period.
- You can view, change or cancel your subscription at any time in the App under Settings, or in the Apple App Store account settings.
- Prices are shown in the App before purchase, in your local currency.
- Payments are processed by Apple. We never see or handle your payment details. Refunds are handled by Apple under its own policies.
6. Acceptable use
You agree not to use the App unlawfully, not to attempt to reverse engineer or interfere with it, and not to present its output as an official or certified measurement.
7. Intellectual property
The App, its name and its design remain the property of Ask White. These terms do not transfer any rights in them to you. Measurement data you create on your own device belongs to you.
8. Disclaimer and limitation of liability
The App is provided "as is", without warranty of any kind, including any warranty of accuracy or fitness for a particular purpose. To the fullest extent permitted by applicable law, we are not liable for any loss or damage arising from use of, or reliance on, the App — except in cases of our wilful misconduct or gross negligence. Nothing in these terms limits rights you may have as a consumer under mandatory law.
9. Changes
We may update these terms. The updated version takes effect when it is published on this page. Material changes will be reflected in the "last updated" date above.
10. Governing law
These terms are governed by the laws of Japan. Disputes relating to the App shall be submitted to the exclusive jurisdiction of the court having jurisdiction over our location as the court of first instance, without prejudice to any mandatory consumer protection rules of your country of residence.
